ok if the high tide water mark ends on a river 10 miles down river cause of a dam from a water fowl hunting spot....were i have permission...corret me if i am wrong but there is no HIGHT WATER MARK UP PAST THE DAM ..CAUSE NO TIDE...PEOPLE GOING ON THIS PROPERTY TO HUNT ARE ILLLEGAL.because the land owner owens the land under the water.....and by them walking onto the property staying in the what they are calling high water mark...they are legal...i say no your not.....hope this makes sence......

I'm pretty sure based on a conversation with an EnConn cop some years ago that you are correct . Call them and ask is your best bet .

i agree i did but my buddy is saying im wrong....i dont think i am...never heard of a high water mark..high tide mark yes ....

My guess is private land starts at the high tide water mark inland.

if there was one..marine in old lyme said the hight tide stops at the damm in wallingford...no tide from the top of the dam up river.....

I would do what ecurB said, call Encon and speak with the officer that covers your hunting spot. Even ask to meet him in the spring to walk the property to get his opinion. Then assuming he agrees that there is no "high water mark" because there is no tidal influence then tell him that when the water fowl season starts in the Fall you are going to be hunting there and also monitoring the spot. If people that don't have permission continue to hunt there call the TIP line or the Encon officers private cell phone and have him come and issue citations.
I would also post the land and add an additional poster that says the land is not tidal and the shoreline and bottom of the water body is privately owned. Once it becomes clear that the private property rights will be enforced then the word will get around and it will stop.
