PLEASE HELP! HIT & RUN OFF MONTAUK PT

Hello everyone, Last night, sept 17, I was fishing the south side of montauk light. I was fishing in a 21.5 FT Seaswirl Striper. At approximately 11 PM, I was drifting, and fishing, and my navigation lights were on. I was struck broadside by a larger boat that was under full power, up on a plane.

Several witnesses came to help, but the boat who hit me turned off his lights and left the scene. I did not get a good look at the boat that hit me. One witness described the boat as approximately a 26-28 White Center Console, very new looking, with twin Yamaha outboards.

My friend and I were not hurt, as we jumped out of the boat at impact. My boat however, is totaled.

PLEASE PLEASE PLEASE, if you have ANY information on what happened, or have seen a boat remotely similar to the description with front end damage, please message me. My boat, and much of my gear is a total loss.

I don't know how someone could sleep at night just leaving the scene like that. In fact, Maritime law states you must render assistance, that would include if you caused the accident.

you should also put it on hulltruth northeast section. That boat is probably slipped and not gonna be hard to find it if word gets out.. Also, maybe contact eh montauk marinas and ask them to post a flyer or something.

If you have not notified the NY DEC, Montauk PD, and the USCG, this should be done ASAP as what you've described is a 'Serious Marine Incident.' It falls within the bailiwick of the CG and will be pursued with a vengeance.

Thanks for the support everyone. The USCG is conducting an investigation. They are the ones who towed me in to montauk last night. My boat took on a LOT of water. I think the foam in the boat is the only thing that kept it from sinking.

I saw this happen about ten years ago on bartletts. Same scenario the guy that ran into the other boat left the scene. I pulled one out of the water but his boat was a mess.

I have a bit of new information. A witness tracked me down on facebook and added these details:

"Was a pretty new contender, approximately 30ft or so with a middle aged male and female on board. After they struck you, they moved south of you and started drifting east for about a 1/4 mile, then they turned off their navigation lights and that was the last I saw of them"

"Definitely a newer contender, if I had to guess no more than 4yrs old.he went up and kinda over your stern"

Wow incredible damage just amazing you didn't get hurt or worse. Seems like they should find this guy quickly and lock his ass up . Start looking for a good attorney and you'll own his house and have a new boat.

Oh man great news!

There has been a lot of chatter about this in montauk so I figured it wouldn't take long to find the guy! Since moving to Long Island I have learned it's a pretty small island amongst boaters.

I mentioned this at Burr's marina when I got gas today. Flyers in as many marina's as u can. Scumbags are probably pulling the boat already. Heard the news when I launched at BOTT'S today. Your lucky to be alive.

Hopefully someone in his marina see's this and notifies you or the cops. His boat has to have damage. More then likely he pulled it for the season now. Contact all repair shops from LI to RI.

Boat Flees Accident in Montauk, Leaving Two People Afloat
Update: The East Hampton Town Marine Patrol, which is part of the town's Police Department, is investigating a boating accident that happened off Montauk Point on Thursday night.

In a statement issued Friday night, Chief Harbormaster Ed Michels said that "a 21-foot Sea Swirl Striper was struck by another boat, disabling it." The accident occurred in the ocean one mile north-northeast of Montauk Point.

Chief Michels confirmed that the second boat left the scene, but said so only after the Coast Guard had responded and escorted the two occupants back to Lake Montauk. with a statement like that i also wonder who the other boater is. you usually don't have law enforcement sticking up for the criminals.

I personally have had several instances when we were about to be run over or hit.

2 times by blow-boating, channel-choking rag-hangers at Long Sand Shoal. We were anchored, chunking for stripers. 2 idiots, one following the other, came within feet of slicing us in two. They never looked up from the wheel until the finally could hear my horn. Believe me, they got an earful.

2 times offshore while drifting in a tuna fleet. First time was 2 guys in a boat named 'Buffalo' that ran off our stern so close he spooled 2 rods and cut the other lines off. I had to hold my friend back from running over to his boat, he wanted to go and beat the crap out of the guy. They were tending their trolling lines, no-one at the helm.

The 2nd time was a longliner headed offshore, probably on autopilot. If we didn't fire up and move we would have cut us in two. We threw 12 oz. sinkers at his wheel house and my buddy was going to put a couple of .45 rounds into the hull. Those guys don't give a hoot who's in their way.

I could also mention several local charter boats that like to walk right up my ass when they want to be on my numbers and I'm hooked up to a nice striper. Ask JLMOS how close the Bluefin IV came off my stern 2 weeks ago at Block Island. 30 feet maybe?

Now, when on my boat, at all times, I have a 12 ga. flare gun loaded and ready, and an air horn. If someone decides to be stupid enough to get close to my vessel they first get the horn. If that doesn't get their attention a smokin' hot flare will enter their cockpit or will sent into their rags. I will let the po-po or CG figure it out later, if they possibly can.

East Hampton Harbor Master Ed Michels said Marine Patrol was still investigating the Thursday night boat hit-and-run in Montauk.

On Tuesday morning, authorities were inspecting the 26-foot boat based in Hampton Bays that allegedly struck a 21-foot Sea Swirl Swiper.

Charges had not yet been filed against the boat pilot who came forward over the weekend.

The pilot of the missing boat that struck a 21-foot Sea Swirl Swiper with two fishermen on board on Friday came forward to authorities over the weekend, said East Hampton Harbor Master Ed Michels Monday morning.

The pilot was scheduled to meet with Harbor Master Michels with his attorney to discuss the incident and deal with any potential charges. Mr. Michels said on Monday he could not release further details about the incident.

They looked at his boat today and these was damage to it. I guess there are a few more things they need to look into, but it feels that the investigation is moving in the right direction at least. I asked the officer about the news update of the other boat not leaving until after the coast guard arrived, and he said he never heard anybody say that.

Don't ever believe what you read in the news. I have been misquoted several times in the last few years, its just sad - they never get it right. I am not sure if it is intentional (to sell papers) or just lack of care. I always assumed that a newspaper editor's job was like an English teacher's job to correct mistakes and fact check - but I don't think they bother any more....

So I thought I read on here that they do know who he is and that know charges are filed yet. Also that when you mentioned to the CG that he fled they said that was news to them. Wow why isn't this guy arrested and why aren't you told that? Sounds like a bunch of BS and maybe he is a "local" who knows people.

I think it's a bit of both. Journalistic ethics and standards seem like a thing of the past. In my experience, they make mistakes even when you take great pains to spoon feed them the right information in the right order because they are only interested in the angle they wish to take and don't pay much attention to the rest of the facts. And most now seem more concerned with creating the news rather than simply reporting it.

Get in touch with the eyewitnesses, reporter and the clueless harbor master. That idiot captain is quickly covering his ass and doling out lots of 'damage-control' cash.

I'm sure that if I did a 'hit and run', I would get cuffed and stuffed.

For example, my car got smashed and the guy hit and run, a witness called him in and he was in jail 45 minutes later. I didn't even know until the next day.

Get a small pad and right down what happened...then keep track of every person you talk to about this. ..what they said...times/dates/names. Good points! This guy has probably spent every day with his lawyer putting together a game plan on how this was YOUR fault. Please get tell me you have your own attorney and are ready to fight, after he left you guys for shark bait.

Just a few days before this incident I spent the afternoon fishing with one of CT's best personal injury/criminal defense lawyers . Great guy , funny as hell , generous with his time working pro bono cases in addition to cash donations to many charities , in his "off duty clothes" just an all around nice guy .

Once he dons his "litigation suit" however , his duty is towards the person who has retained him . No matter how vile or putrid the acts of his client may be , once the retainer has been received it is game on against the other side . I can't even imagine a regular guy attempting to defend themselves against this guy , let alone tying to recoup physical/punitive damages .

My advice...

1. Maritime Attorney....
2. Attorney SPEAKS only for you (or with their input).
3. Say nothing to the MP or CG without an attorney's advice... See 1 & 2.

This is a situation where the injured party is rapidly sailing into shallow shoals of their own making- if they've not retained a lawyer. The scumbag's lawyer will eat him alive if, as he's stated, "I've been in touch with them (MP) every day," and are discussing the incident without a lawyer's input. I've see too many 'open and shut' cases of maritime accidents go sideways because of Admiralty Law. It's quite possible that Nick and his buddy are being sandbagged by the perp's lawyer and, quite possibly, with the marine patrol's collusion (Chief's attributed statements).
It's costly, but without a good lawyer (and no insurance), they're probably going to get an outcome that will be very disappointing, if not shocking. Some blame will be assigned by the CG due to the Cardinal Rule of Seamanship: 'Close lookout, safe speed.' Even through they were hit (and the scumbag ran) and are 'the injured party.' They, under CG Regs & Admiralty Law, "should have had a close lookout," i.e. watchstander & radar (all means available) http://www.navcen.uscg.gov/pdf/navrules/navrules.pdf.
That's almost a given in any maritime collision- dsy or night- regardless of who's mainly 'at fault' or who has 'right of way.' However, that doesn't mean that the they'd 'lose the case,' it's just the way the law reads.
A lawyer will coach the terms used to be included in the Marine Patrol's final report and at the CG Hearing in order to put the great majority of the blame where it should reside- on the scumbag.
Please, retain the services of a maritime attorney!

That way, if you don't know or don't know someone who knows a maritime attorney, they can match you up with one. It may be time to go on the offensive.

I hate to burst some bubbles here, but since the OP mentioned in his initial post that he nor his passenger were injured from this event. My take is (and someone correct me if I am wrong) that the OP may be only entitled to reparations for his damaged boat. In the end, whether or not the individual who caused the mishap stuck around the scene has no bearing on an insurance payoff. Character or lack thereof, does not compel an insurance carrier to pay out more cash than is due. I am not sure if jumping into bed with a lawyer in this particular case is worthwhile. We may be talking about fair market value of a 21' Seaswirl and that's it.

Don't forget the very expensive combos and tackle box (filled with very costly lures & jigs) that was lost, at the bottom of LIS.

the other boater should be looking at jail time. I bet if that were to happen 10 times, 9 out of the ten times, you would have died. The fact that he took off with out checking on you shows malice and he needs to be prosecuted. It's a miracle you guys lived, if you were at the stern, you would have been toast.

BTW, most civil suit lawyers only charge you if you win the case and they take a percentage of the settlement. If if you were to hire a criminal defense attorney then you would have to come out of pocket up front.

I don't think this is a case where he is or should be trying to go after pain and suffering type damages. The situation reeks of the other party preparing to not be held responsible for the incident.

Please get an attorney. This asshat is going to show up in a neckbrace claiming that you were out there with no lights and caused him great physical and mental harm - your fault. His word vs yours. If he is in bed with local law enforcement you are screwed

At the very least, talk to an attorney. Most lawyers give a free initial consultation.

Don't get your legal advice from a fishing website. Anything you post here, could possibly be used against you.

Get a lawyer, to keep the authorities honest. It sounds like you could be in for a long-assed fight.

There are two separate issues here. A criminal issue and a civil issue. On the criminal side, the other boater took off, leaving the scene of the accident, and with people in the water. I do not believe he will be able to mount too much of a defense against that. Even if he were to blame you for the accident, he still took off, and with you in the water. He's got a problem here. Your only job here will be as a witness to a crime.

For the civil matter, this is where your own attorney is needed. Should the other boater try to blame you, you need an advocate to show that you were not at fault. If you're fishing, lights on, you have the right of way. The impact will show that there was speed involved, which could not be you, since you WERE fishing, and thus not moving at a significant rate of speed. You have to be made right, financially. This means loss of boat, tackle, equipment, transportation costs, and any medical expenses, etc. Any pain/ suffering, etc. will have to be worked out with your attorney.

We had a meeting with the police last week to give statements. They said they still had a few witnesses to interview. Probably won't hear anything for another week or two. Much slower process than I thought it would be.

Good Luck. My brothers wife was killed in Newington 4 weeks ago in a hit and run. The driver left her to die like an animal in the road and he still hasn't been charged.

This is true, and they will take the case on a contingency basis. Also keep in mind, his insurance company is just silently hoping you will not.

Be careful taking money to have the boat replaced, it's possible that could be seen as a complete settlement. If you intend to pursue this further talk to the lawyer before you take any money.

If the guy is the big jerk your friends tell you about, then he DESERVES to be sued. He'll settle out of court before letting himself be put on the stand, under oath.


Your attorney will just take a percentage of the (guaranteed) win. It'll cost you nothing up front.
