A first-time DUI, (or, in some states, "DWI" -- short for "driving while intoxicated") is normally charged as a misdemeanor, not a felony. But if someone was injured as a result of the drunken driving, some states will raise the charge to a felony -- and if the victim dies, some of these states will charge the driver with reckless homicide.
Also, in a number of states, a DUI will be raised to a felony if it is the driver's second, third, or even fourth DUI offense.
If he gets a pardon ( done twice a year) his record will be clean but u have to stay out of trouble for at least 5 yrs to apply . . either wit a lawyer or by ur self
It's unfortunate your bud got in trouble...but it sounds like this either was not a simple 1st offense or something really bad happened as a result. I don't think a first offense DUI is an automatic felony.
While he might not be violent at all, getting a felony DUI certainly demonstrates an incredible level of irresponsibility. It's not like littering, or running a red light...this is some serious stuff.
When my father taught me to shoot handguns, I still remember him drilling into my head, the level of responsibility I would need to demonstrate...the level of discipline and respect for this thing that could take a life as easily as point and click.
If your buddy can't demonstrate to "society" that he is responsible enough to avoid becoming a felon, then I would not want to be near this dude with a loaded gun.
Let me be clear though. I fully support firearm ownership for everyone, and their grandma, but how low are we going to set the bar for acceptable adult behavior these days?

Even if the system screws you, it is only broken if it has screwed everyone. Plenty of people manage to get through life without ever running into a legal issue.
This guy can go to the DOC website and find the application and apply for a pardon. They look at the applications every 90 days. He can apply but no one says he'll be granted one. Usually people who get pardons are because they need it for work to support thier families through legit means and not to go hunting. Good luck fishing
