What power does our representative government have to set fisheries regulations? Aren't the regulations set by DEP in response to mandates set forth by ASMFC? The federal regulators indicate that menhadden are not being overfished. I am not sure how they would set a limit on personal use.

I wouldn't give up yet fellas. If I was the officer and I had a partner waiting in an unmarked car to follow them I surely wouldn't tell a soul. Lets hope that the DEP is on this like white on rice at an illegal tautog suhi bar. My gut tells me that the Captain might have a few tricks up his sleeve for you.
While I can't speculate on this case and what EnCon may have up their sleeve , I can tell you for sure that when they get their teeth into certain things they don't let go .
Without going into it too deeply , a "personal acquaintance" was on "the list" for years . The guy had balls of titanium and was certainly a worthy adversary . His exploits were well known but he was pretty slick and hard to catch . EnCon never forgot about him , they got him this year after probably 15-20 years of cat and mouse . This guys "career" lasted almost as long as an EnCon officer , but they never gave up on him . In the end he was arrested on charges much more serious than those originally intended . He screwed up that one time and they capitalized on it .
When I read these posts and the one about the fellas in New Haven Harbor , it makes me think that there is an "operation" somewhere up in Mass. supplying the equipment to willing participants who are just looking to make a buck . Send them off to different locations , fill up the boats and bring them back for the payday . Getting the people supplying the boats and the cash would be a real prize . It would be quite a feather in someones cap if they were able to crack an interstate "bunker cartel" . There may not even be too much time and work involved if these guys are as brazen as it appears .
