OK...would you rather have the state ignore the public health risk and not do anything about it? I'm sure the lawyers would be lining up to sue the state for every person that came down with any disease who went fishing there if reasonable steps were not taken until the water clears up.
So why is it necessary to ban fishing altogether. I can perhaps stretch to imagine banning the taking of fish. Banning Catch and Release activities in the eyes of the commissioner will protect Human Life? Maybe banning numbskulls who keep matches near a warehouse full of explosive chemicals in a residential area would be more productive at reducing threats to human life?
Because there are people out there who will eat the fish - it's a potential public health issue.
