If you look at the definition of daily creel limit in the anglers guide it seems to indicate that a fish caught and released is included in the creel limit. If I catch and release 2 28 inch stripers and catch and keep 2 30 inch stripers, what is my daily creel?

Daily Creel Limit: The quantity or number of fish of a species or species group that can be taken by an individual angler during the period from 12:01a.m. to midnight. Any species taken to the contrary must be returned immediately, without avoidable injury, to the waters from which it was taken.

You can catch and release as many fish as you want before, during, and after you have kept your creel limit of 2 fish...

No Culling fish also... IE you cant keep the fish in a livewell and dump the smaller one if you get a bigger one...

it says that in there somewhere....

The confusing part is how it's written , using the word "taken" in two different contexts .

" The quantity or number of fish of a species or species group that can be taken"....
Equals fish kept .

"Any species taken to the contrary"....
Any out of season incidentals that wind up on the hook .

"the waters from which it was taken"....
Same context as #2 .

As said , no culling .
Gotta be a bit careful when there is a limit in the box though IMO , if you're fishing bait rig up with circles , etc...
Those Green Guys notice stuff like that .

What if I decide to keep 2 and catch another and my buddy has kept none. Can I keep a 3rd as we're fishing together? Or do I need to release it?

I wouldn't seek out technicalities, but I know of people that have taken their 5 year olds tog fishing to up the creel and they were inspected by someone at the clinton docks last year.

Technically you each have to catch your own bag limit .
If you duck hunt and have ever argued with a Fed over "community body piles" you'll know what a cluster#$@% it could turn into .
It would really be a matter of how fine you want to tune your "legality" , and if the Green Guys have been scoping you out .

99% of the Time the green guys are cool as long as your not A. Sketchy or B. a d!ck.

If you go striper fishing on a boat and there are two guys on the boat DEEP is looking to make sure that A. the fish are over 28" and B there are only 4 fish max.

Unless you say, Hey DEEP i caught 4 and this other guy caught none. they will turn a blind eye. IE dont be a fool.

I have been boarded many times and never had a DEEP guy ask "Who caught which ones?"

Stay with in your boat limits and your fine.

Technically - Yes, 2 per person and you need to catch you own.

But its also illegal to go 66 in a 65.....

If the fish is under/over legal length you can't keep it so it doesn't count towards your creel limit. Culling is not permitted, but that's swapping out one legal size fish for another legal size fish.
