I kill about 5-6 every year in my garden, they eat my cherry tomatoes.

Rat Trap is definitely the way to go. I set 2 rat traps amongst my tomato plants and had one chipmunk in each trap on more than one occasion. I bait it with what they are eating, cherry tomatoes.

A cat will do a number on the chipmunks also.

Perhaps, but then you are faced with the even less desirable presence of a cat.

use a bucket trap (google it) that way you don't have to keep setting the trap, just bait it and let them drown, dump the dead ones once a week.

The live trap and release 3+ miles away had been lowest on my list (mainly because I can't imagine they wouldn't find their way back, and effort) but DMV eh? (I kid, I kid. Since I found out about the AAA secret license renewal places I thankfully haven't been to a DMV in ages!)
