GOVERNOR MALLOY PROPOSES CONSOLIDATED

DEPARTMENT OF ENERGY & ENVIRONMENTAL PROTECTION

(HARTFORD, CT) – Governor Dannel P. Malloy today announced his plan to create a newly consolidated Department of Energy and Environmental Protection (DEEP), an agency that will consolidate Connecticut’s widely dispersed energy functions, including the Department of Public Utility Control, with the Department of Environmental Protection to allow for a more effective coordination of state energy and environmental policies.

“Merging these two functions under one leader will allow the state to act cohesively in two vitally important and directly related policy areas, particularly in terms of economic development, siting, permitting and other issues,” Governor Malloy said. “Under this new agency, we will better integrate and coordinate our state’s energy and environmental policy in order to strengthen our ability to protect the environment; to clean, conserve and lower the cost of energy; and to set the table for rapid and responsible economic growth.”

Creating the new Department of Energy and Environmental Protection will enable the state to continue its environmental conservation and regulation functions and to couple them closely with energy policy and pricing. Organizationally, the state’s energy policy will become centralized in the agency through the creation of two new bureaus: the Bureau of Energy Policy and Efficiency and the Bureau of Utilities Control.

The Bureau of Energy Policy and Efficiency will be responsible for the development and analysis of energy policy as it affects all of Connecticut’s citizens and businesses through its Division of Energy Policy and Program Development. The bureau’s Division of Government Energy Management will be responsible for the effective management of energy costs and energy usage by and within state government buildings and facilities. Existing staff from the Office of Policy and Management Energy Unit will be transferred into this bureau.

DEEP’s second energy bureau, the Bureau of Utilities Control, is formed by transferring the Department of Public Utility Control, which will continue to be responsible for conducting management audits of the public service companies; scheduling, coordinating, and issuing legal notices, and conducting public hearings and adjudicating all contested cases; conducting investigations into generic issues and conducting or sponsoring management audits of specific utility functions.

You could almost see that working in conjunction with proposed HB 5363 AN ACT TRANSFERRING THE CONSERVATION FUNCTIONS OF THE DEPARTMENT OF ENVIRONMENTAL PROTECTION TO THE DEPARTMENT OF AGRICULTURE. Ther could be a cost saving AND better focus on each organization's mission.

The NGOs are going to flip when they see CTDEP and Energy under one roof. From their perspecive it will seem like there is too much opportunity for the energy interests to influence CTDEP policy and decision making.

Its complicated - look for the NGOs to try to block or derail this.

I am open to any changes that set the stage for greater efficiency.

Advocacy groups like Connecticut Fund for the Environment or Connecticut Forest & Park Association, Connecticut Conservation Association. etc etc . . . its a long list.

Malloy names Yale professor, Obama adviser as environment commissioner

Gov. Dannel P. Malloy today named Daniel C. Esty, a Yale professor with a national reputation for reconciling environmentalism and economic growth, as his choice to run a new Department of Energy and Environmental Protection.

Esty, an energy adviser to Barack Obama's transition team, is the author of nine books, including a volume that marked him as an environmentalist attuned to economics, "Green to Gold, How Smart Companies Use Environmental Strategy to Innovate, Create Value, and Build Competitive Advantage."

"Specifically, it is not an environmentalist telling businesses how to behave, but is a business perspective on bringing the environment into corporate strategy," one reviewer wrote.

Esty was reported two years ago as being on Obama's short list for possible administrators of the Environmental Protection Agency.The book reportedly brought Esty to the attention of then-candidate Obama.

Esty is the latest Malloy appointee whose selection reflects the governor's interest in finding appointees with expertise in business growth.

Esty is the Hillhouse Professor of Environmental Law and Policy at Yale and holds faculty positions in the university's environment and law schools. He also serves as the director of the Yale Center for Environmental Law and Policy and the Center for Business & Environment at Yale.

Esty is married to former Rep. Elizabeth Esty, D-Cheshire.

Malloy is naming Esty to run an agency whose existence will require legislative approval. Until the proposed consolidation is approved, he will be the commissioner of environmental protection.

We'll see, I guess.

Does Malloy have the authority to consolidate these entities into one, or is this just a proposal?

No - it needs legislative review & approval. But its far more than a proposal - from what I hear it looks like support is very broad and the wheels are turning to facilitate this happending very quickly.
