The prohibition against Sunday hunting is probably unconstitutional on the basis of the 1st Amendment Right to Assemble. This is the argument that was used to open public facilities to non-residents like with parks, beaches and boat launches. It was the argument we used with AG Blumenthal at the Town of Morris Bantam Lake boat launch.
Ironically, this argument is probably better made with Sunday hunting in state forests than it is on private lands but there are other constitutional arguments with private lands that could also win.
